1. Acceptance of Terms
By accessing or using any part of the HostInfo platform, including our website located at hostinfo.com, our REST APIs, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service.
These Terms apply to all visitors, users, registered account holders, and API consumers. HostInfo reserves the right to update or modify these Terms at any time. Your continued use of the Service following the posting of any changes constitutes your acceptance of those changes. We will make reasonable efforts to notify you of material changes via email or an in-product notice.
If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms, in which case the terms "you" and "your" shall refer to that entity.
2. Description of Service
HostInfo provides internet infrastructure intelligence services, including but not limited to IP address geolocation and enrichment, domain WHOIS lookups, DNS record retrieval, SSL certificate analysis, ASN data, hosted domain enumeration, privacy and proxy detection, and related data products accessible through our website and REST API.
The Service is provided on an "as is" and "as available" basis. We do not guarantee the completeness, accuracy, or timeliness of any data returned by the Service. Internet infrastructure data is inherently dynamic and may become stale between updates to our data pipeline. We disclaim any liability for decisions made based on data returned by the Service.
We reserve the right to modify, suspend, or discontinue any feature of the Service at any time, with or without notice, and shall not be liable to you or any third party for any such modification, suspension, or discontinuation.
3. API Usage & Rate Limits
Access to the HostInfo API requires a valid API key issued through your account dashboard. Your API key is confidential; you must not share it publicly or embed it in client-side code. You are responsible for all API usage under your key. If you believe your key has been compromised, you must rotate it immediately via your account settings.
Each subscription plan carries a defined monthly request quota and per-second rate limit. Exceeding your monthly quota will result in API responses returning HTTP 429 until the next billing cycle unless you upgrade your plan. Automated circumvention of rate limits — including key rotation, IP rotation, or request distribution across multiple accounts for the purpose of exceeding plan limits — is strictly prohibited and may result in immediate account termination.
You agree not to use the API to build or power a competing data intelligence product, resell API data as a standalone offering, or compile bulk datasets for redistribution, except where explicitly permitted under an enterprise data licensing agreement signed by HostInfo.
4. Account Registration
To access paid features and the API, you must create an account by providing a valid email address and a secure password, or by authenticating through a supported OAuth provider. You agree to provide accurate, current, and complete information during registration and to keep that information updated.
You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. HostInfo will not be liable for any loss or damage arising from your failure to comply with these security obligations. You agree to notify us immediately at [email protected] if you suspect any unauthorized access to your account.
You must be at least 16 years of age to create an account. Accounts created by automated means or bots are prohibited. HostInfo reserves the right to refuse registration or cancel accounts at its sole discretion.
5. Payments & Refunds
Paid plans are billed on a monthly or annual basis, in advance, via the payment method on file. All prices are listed in United States dollars and are exclusive of applicable taxes unless otherwise stated. You authorize HostInfo to charge your payment method for the applicable fees on each billing date.
If a payment fails, we will retry the charge up to three times over a seven-day period. If payment remains unsuccessful after retries, your account will be downgraded to the free tier and API access will be suspended until payment is resolved. You are responsible for keeping your payment information current.
Monthly subscriptions may be cancelled at any time; your access will continue until the end of the current billing period and no further charges will be made. We do not offer prorated refunds for partial months on monthly plans. Annual plans cancelled within 14 days of the initial purchase may be eligible for a full refund at our discretion. After 14 days, annual plans are non-refundable. If you believe you have been charged in error, contact [email protected] within 30 days of the charge.
6. Data & Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of information as described in the Privacy Policy. Our Privacy Policy explains what data we collect, how we use it, and your rights with respect to it.
The data returned by our Service is sourced from publicly available internet infrastructure records, including IANA registries, regional internet registries, public WHOIS services, and active DNS queries. We do not use our Service to track the browsing behavior of individual end-users of our customers' applications.
You acknowledge that some data accessible through the Service may include personal data as defined under applicable data protection laws. You are responsible for ensuring that your own use of such data complies with all applicable laws, including the GDPR, CCPA, and other relevant regulations. HostInfo is not liable for misuse of data retrieved through the Service.
7. Intellectual Property
The Service and its underlying software, algorithms, data compilations, documentation, trademarks, logos, and all other content are the exclusive property of HostInfo and its licensors and are protected by applicable intellectual property laws. Nothing in these Terms grants you any ownership interest in the Service or its content.
Subject to your compliance with these Terms and payment of applicable fees, HostInfo grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service and the data it returns solely for your own internal business purposes. This license does not include the right to sublicense, resell, or redistribute any portion of the Service or its data.
Any feedback, suggestions, or ideas you provide regarding the Service may be used by HostInfo without restriction or compensation. You represent that any content you submit to the Service does not infringe the intellectual property rights of any third party.
8. Limitation of Liability
To the maximum extent permitted by applicable law, HostInfo and its officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages — including but not limited to loss of profits, loss of data, loss of goodwill, service interruption, computer damage, or system failure — arising out of or related to your use of, or inability to use, the Service, even if HostInfo has been advised of the possibility of such damages.
In no event shall HostInfo's total liability to you for all claims arising out of or relating to these Terms or your use of the Service exceed the greater of (a) the total amount you paid to HostInfo in the twelve months immediately preceding the claim, or (b) one hundred United States dollars (US $100).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by applicable law. The limitations set forth in this section do not apply to liability for gross negligence, wilful misconduct, or fraud.
9. Termination
You may terminate your account at any time by contacting [email protected] or using the account deletion option in your dashboard settings. Upon termination, your right to access the Service ceases immediately, and we may delete your account data in accordance with our data retention policy as described in our Privacy Policy.
HostInfo reserves the right to suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice. Grounds for termination include but are not limited to: violation of these Terms, fraudulent or abusive behavior, non-payment of fees, illegal use of the Service, or any conduct that HostInfo determines to be harmful to other users, third parties, or the integrity of the Service.
Provisions that by their nature should survive termination shall survive, including but not limited to: intellectual property provisions, warranty disclaimers, limitations of liability, indemnification obligations, and governing law provisions.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in New Castle County, Delaware for the resolution of any disputes arising from these Terms or your use of the Service.
Notwithstanding the foregoing, HostInfo may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights or to prevent irreparable harm. If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect, and the unenforceable provision shall be modified to the minimum extent necessary to make it enforceable.
These Terms, together with the Privacy Policy and any applicable order forms or enterprise agreements, constitute the entire agreement between you and HostInfo with respect to the Service and supersede all prior or contemporaneous understandings regarding such subject matter.
